The New York State Division of Criminal Justice Services issued an alert this week to local residents regarding the residency of 48-year-old Nelson Acevedo, who has moved from Long Island City to a residence on Albany Post Road in Montrose.
The Division of Criminal Justice Services has assigned Acevedo, a former counselor at The Guidance Center of Westchester, as a level two threat, which means he is at "moderate risk of a repeat offense."
Acevedo was charged with sexually abusing his victim on three different occasions during counseling sessions in the office in New Rochelle and raping the victim during a session at Acevedo's place of residence. The incidents took place between Feb. 1 and July 31 in 2013.
At the time of his arrest, the district attorney's office said the victim was incapable of consent because she was a patient and the defendant was a mental health care provider and the sexual acts occurred during a treatment session.
According to the Division of Criminal Justice Services, Acevedo had sexual intercourse and contact with his victim in July 2013. He was sentenced to six years probation in January the following year after being convicted of attempted criminal sexual act with a person incapable of consent. Acevedo is now under the jurisdiction of the Westchester County Department of Public Safety.
